Distinguish physical access from a right of way

The Civil Code provides for a right-of-way easement and its conditions. The use of a path is not enough to determine, without reviewing the background, who may pass and to what extent.

Gather deeds, registry information, plans and available agreements. Explain where the land is currently accessed, since when, how it is used and what objection has arisen.

Compare the fence with the documentation

If there are disagreements about the boundary, gather the reference plan and available measurements. ANATI publishes requirements for verifying measurements and boundaries that include registry records and technical work.

Mark the disputed points on a copy to explain the problem. Keep the original and seek help from an appropriately qualified professional when the land needs to be measured or represented technically.

Document the problem before acting

Organize lawfully taken photographs, dates, communications and an explanation of what happened. Indicate whether there is a summons, inspection or ongoing procedure.

Before moving fences, opening a passage or blocking a path, seek guidance on the situation and the alternatives. If you are buying, include access and boundaries in the prior review and in the points the seller must clarify.
