Start by reconstructing the agreement

You lent money and the agreed repayment date has passed. You may have messages, transfer records or partial payments. The first review organises that information and examines what obligation can be established.

The absence of a signed contract does not by itself mean that all is lost; nor does it mean that a screenshot or transfer record is enough to obtain payment. The obligation’s origin, terms and rules of evidence must be examined together.

What money you provided and why

Explain whether it was a loan, payment for work, an advance, a business contribution or something else. Identify the people involved and what was agreed about repayment, instalments and dates.

A transfer record documents a movement of money to the extent shown on the record. Its explanation depends on the other circumstances. Include earlier and later communications that help explain the agreement and any disagreement between the parties.

Prepare a timeline and balance

Separate money provided, payments received and the balance you consider outstanding. Note dates, purposes and supporting records. Include later agreements or extensions in the timeline.

If you claim interest or other charges, identify where they were agreed and how they were calculated. Their legal basis must be reviewed; amounts should not be added without identifying their grounds.

Disclose previous demands, acknowledgments, notices or court proceedings. Dates may affect limitation periods and the available options.

Preserve complete conversations

Keep available original records and conversations in context. Avoid editing, cropping or deleting messages about the debt. Include objections, changes to the agreement and partial payments.

Screenshots can help explain an initial enquiry. They do not by themselves determine how authenticity, integrity or evidential weight will be established in proceedings. Any specialised technical examination is separately scoped.

Do not publish conversations or personal documents to pressure someone to pay. Coordinate the appropriate channel for delivering your consultation documents with the firm.

If you have a promissory note, acknowledgment or signed agreement

Provide the entire document and subsequent payment records. Its terms, maturity, balance and applicable formalities must be examined; a signature alone does not turn every document into a basis for enforcement proceedings.

Panama’s Code of Civil Procedure distinguishes the requirements and instruments for enforcement. The route must be assessed according to the document and applicable rules. If proceedings already exist, provide their starting date and available court records so transitional rules can also be reviewed.

Compare the options and costs

Review may help define a payment demand, negotiation or court claim. Each has its own scope, documentation and costs. No single route is promised for every debt.

Beyond evidence, consider the amount, settlement possibilities and lawfully available information about compliance with a potential judgment. Obtaining a decision and actually receiving the money are different outcomes.
