Distinguish the debt balance from the registry status

Paying an obligation does not, on its own, amount to documenting its discharge in the registry against third parties. The Civil Code regulates the documents and acts that allow a mortgage registration to be canceled.

Gather the loan and property information. Request from the creditor the balance for the planned date, its payment terms and the documents it would provide to arrange the discharge.

Define how the price will be distributed

Prepare a working table showing the price, balance owed to the creditor, expenses, taxes and amount expected for the seller. Distinguish estimates from confirmed figures and identify when each quotation expires.

Ask for the agreement to explain who receives each payment and what supporting document is provided. If the buyer also needs financing, coordinate both institutions’ requirements before assuming a closing schedule.

Organize documents and handover

Review with your lawyer the sequence of signing, payment, filing and registration appropriate to the transaction. Note who will hold and deliver the documents and how progress will be verified.

Agree in writing on the date and conditions for handing over the property, keys, occupancy, utility balances and any outstanding obligations. Keep payment records and the results of registry procedures.
